BOLD REPRESENTATION. SOUND RESULTS.
If you can no longer work due to a disability, you may qualify for benefits under the Social Security Disability Insurance program. Unfortunately, however, gaining approval can be much more difficult than it should be. SSDI cases are very unique and require experience to achieve the best possible outcome. At Vinsko & Associates, P.C., we review your medical condition, review your medical history and compare your issues against the federal Social Security law to make a determination whether you are entitled to an award. We can also help you appeal a denied claim.
If you are an adult, we must assist you in showing that you meet the definition of being “disabled” by showing both of the following:
(a) you are unable to do any substantial work because of your medical condition(s); and
(b) your medical conditions have lasted or are expected to last at least one year, or be expected to result in your death
The SSDI program pays benefits to you and certain family members if you worked long enough or recently enough, and paid Social Security taxes on your earnings. If you have limited income and resources and therefore do not qualify for SSDI, you can potentially qualify for Supplemental Security Income (SSI) if you are determined to be disabled. The medical requirements for SSDI and SSI are the same, and our Social Security Disability lawyers will guide you through this process to give you the best opportunity for a favorable outcome.
The application and appeal processes for Social Security Disability cases can be long and frustrating. The federal government has mandatory time frames that often necessitate patience for all involved. However, during those periods between the filing deadlines and the appeals hearing, for example, our team of Social Security lawyers and staff will gather all of your medical records, reports, and work history, among other information, and prepare the case in a manner that will attempt to prove to the administrative law judge that you meet the qualifications for a disability award.
In most instances on appeal, the government will have doctors and vocational experts who will review your records and case, and make a judgment call as to whether you can work. It is our job to present enough evidence to show that you qualify for disability and that your medical conditions, work history and day-to-day living conditions prevent you from working.
If you feel that you qualify for Social Security Disability or if you have been denied benefits from your initial application, contact Vinsko & Associates, P.C., and our offices in Wilkes-Barre and Philadelphia. We will review your case and guide you through an appeal. To get started, call 570-970-9700 or send us an email.
